Below we present the Terms and Conditions of Use (“Terms”), a document that contains the main rules that must be observed by everyone who accesses or uses the features of the PopMe Platform of:

As a condition for accessing and using the Platform’s features, you declare that you have fully and carefully read the rules of this document, being fully aware of and in agreement with them.

These Terms establish the conditions for using the Platform and accessing the features offered, which include access to videos recorded in real time by users, information about our services, and access to the service channels.

We are always seeking to improve our services and features; therefore, these Terms may be adjusted at any time, without the need for prior notice.

Basic Concepts

For a better understanding of these “Terms”, the following definitions should be considered:

Service Channels: means of contact made available by PopMe for user support.
Access Account: an account created to use the Platform’s features, through which it is possible to access products and make purchases.
Sensitive Personal Data: any Data regarding racial or ethnic origin, religious belief, political opinion, membership in a union or in an organization of a religious, philosophical, or political nature, data concerning health or sexual life, genetic or biometric data, when linked to a natural person.
Personal Data: data relating to a natural person that is capable of identifying them or making them identifiable. For example: name, e-mail, ID number, personal preferences, IP address, geolocation.
Data: for the purposes of these “Terms”, encompasses Personal Data and Sensitive Personal Data.
Officer or Data Protection Officer (DPO): person appointed by PopMe to act as a communication channel between us, the holders of the Personal Data, and the competent national authority, such as the National Data Protection Authority (ANPD) within Brazil.
Layout: the set comprising the appearance, design, and flows of the Application.
Link: terminology for an internet address.
Platform: designates the PopMe application.
Processing: any operation carried out with Personal Data, such as those referring to collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of the information, modification, communication, transfer, dissemination, or extraction.
User or You: natural or legal persons registered on the Platform.

The content available on the Platform can be accessed by everyone, free of charge and, in general, does not require prior registration from visitors.

Mission and Concept

PopMe is a digital trust infrastructure. Our mission is to ensure that shared content is an authentic reflection of reality, prioritizing trust and context over algorithmic reach.

Platform Features

Features. The PopMe platform offers the following features:

Instant videos with dual camera
Interaction through reactions
Video comments, creating real chains of interaction
Grouping of Pops by context
Creation of challenges for integration among users

Access criteria. We may change the eligibility criteria for accessing and using the Platform at any time and at our discretion, without the need for communication or prior notice to you or any third party. It is extremely important that you, when using our features, always check the current rules.

Refusal of access. We may refuse, not approve, cancel, or limit any access requests if you do not provide the correct data. The same procedure will apply during the use of the Platform if it is used fraudulently or in a way that attempts to violate or violates these Terms, or any applicable legislation.

E-mails. By providing your data, you agree that you may receive, at the e-mail and/or phone number provided, messages with notices from PopMe. Note that, through the Service Channels, at any time, you will always have the option to suspend the receipt of these communications, as long as they do not affect the operation necessary for the services provided, in particular communications regarding the pension plan or loans made by you.

Presentation of the Platform. The Platform and its features are presented to you in the manner in which they are available at the time of access, but they may undergo constant improvements and updates without the need for prior notice, which is why layouts may vary.

In this case, PopMe undertakes to preserve the Platform’s features with reasonable efforts, using a Layout that respects usability and navigability whenever possible, as well as displaying the features in a clear, complete, precise, and sufficient manner so that there is a correct perception of what is being done, and to protect, through the state of the art available, the data collected by the features provided.

Digital Security. We care about your security when using the Platform; therefore, through our internal procedures, we are constantly improving our techniques, aiming to guarantee the authenticity, confidentiality, and integrity of the information provided to us. We remind you that the security of your data does not depend exclusively on PopMe, so You must also always pay attention to the guidance presented to You.

Membership and Registration Conditions

Registration on the Platform. To access the Platform’s features, the user must complete a prior registration, providing valid personal information, such as full name, date of birth, gender, phone number, address, and e-mail. Registration will be completed by creating a personal and non-transferable access password, with the user being solely responsible for maintaining the confidentiality of this information.

Providing false or incorrect information may result in the suspension or deletion of the account, without prejudice to other legal measures.

Available Features. The Platform offers free and paid features, accessible according to the type of registration and the plan contracted:

Paid Features:

PopMe Pass

The PopMe Pass is PopMe’s official premium subscription program, created for users, creators, and brands who wish to expand their possibilities within the platform.

Through the PopMe Pass, subscribers will be able to unlock advanced resources, exclusive tools, differentiated experiences, monetization features, and priority access to news from the PopMe ecosystem.

The PopMe Pass was developed for users who wish to go beyond the platform’s basic experience, offering more control over their presence, greater creative capacity, access to strategic resources, and growth opportunities within the community.

The PopMe Pass has specific modalities for different user profiles, including Popster, Creator, and Brand, each with its own features, benefits, and conditions. The resources available in each modality may be changed, expanded, or updated periodically by PopMe.

Details related to prices, benefits, usage limits, renewal conditions, regional availability, and features included in each plan may vary according to the user’s profile, service availability, and future platform updates.

PopMe Pass — Plus

Plan developed for users who wish to expand their presence, personalization, and control within the platform.

The Plus plan may include resources such as advanced profile personalization, greater capacity to create Pops, additional interaction tools, enhanced controls for comments and interactions, as well as access to performance metrics and dashboards.

PopMe Pass — Creator

Plan developed for creators who wish to transform audience, community, and engagement into sustainable monetization opportunities within the PopMe ecosystem.

The Creator plan may include tools aimed at monetization, affiliate programs, exclusive publishing formats, access to commercial features, connection with brands, advanced resources for community management, and dashboards related to performance, monetization, and audience growth.

PopMe Pass — Brand

Plan developed for brands, companies, and organizations that wish to use PopMe as an environment for presence, relationship, campaigns, and brand intelligence based on real interactions.

The Brand plan may include access to brand monitoring and intelligence tools, real-time sentiment analysis, activations with content generated by verified users, business dashboards, competitive metrics, campaign resources, and advanced features aimed at managing communities, creators, and experiences within the platform.

Access to specific features will be linked to the user’s active plan or package, the description of which will be available on the Platform at the time of contracting.

Single registration. Registration on the Platform is limited to one (1) account per valid e-mail address. It is expressly prohibited for the same user to create or use multiple registrations, under penalty of suspension or cancellation of the associated accounts.

Cancellation Policy. The user may request the cancellation of their subscription or contracted plan at any time through the logged-in area of the Platform or through the service channels provided.

For cancellations after the initial charge, there will be no refund of amounts already paid, but the user will continue to have access to the contracted features until the end of the current period.

Suspension for Default. Failure to pay or default on paid plans will result in the automatic suspension of access to the contracted features until the pending amount is settled.

Change or Update of Plans. The user may change or update their plan directly in the logged-in area of the Platform. Any price differences resulting from upgrades or downgrades will be calculated proportionally to the remaining period of the current plan.

Legality of Your Data. No obligation of PopMe will be presumed regarding the processing of any of Your Data if there are reasons to believe that such processing could impute to PopMe any violation of any applicable law, or that the Platform is being used, at our sole discretion, for any illegal, unlawful, or immoral purposes.

Your Use of the Platform

Eligibility. Eligible to access the restricted areas of the Platform are users over 18 years of age, duly registered, who fully accept the Terms of Use and, when applicable, are in compliance with the conditions of the contracted plan.

Access to specific features will be configured according to the user’s active plan or package, ensuring that the access profile is aligned with the contracted resources.

Integrity of the information. You are solely responsible for the truthfulness and integrity of the information provided when using the Platform. The use of false, outdated, or third-party information without proper authorization may result in the suspension or termination of access, as well as legal sanctions, where applicable.

The user undertakes to keep their data updated, making changes directly in the logged-in area of the Platform or through the support channels provided by the Platform.

Integrity of the Platform. You undertake not to access the Platform’s programming areas, its database, source codes, or any other set of data available in these environments, as well as not to perform or allow reverse engineering, nor to translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute, or otherwise improperly dispose of the Platform’s features.

The user is strictly prohibited from:

Using software or methods to simulate geolocation (fake GPS).
Injecting pre-recorded or edited videos as if they were real-time captures.
Attempting to bypass “Proof of Life” or biometric authentication.

Confidentiality. If participating in product tests or restricted experiences, the user is obliged not to reveal or distribute information, sketches, or media content accessed during the activity.

No data mining. The use of data mining software on the Platform is prohibited, of any type or kind, in addition to any other not specified here that acts in a similar manner.

Violation of the Terms. In the event of a violation of any provisions contained in the Terms, you must indemnify PopMe and any third parties harmed for all losses, damages, including those of a moral or competitive nature, expenses, or other charges caused by such violation, including, but not limited to, attorneys’ fees and court costs due to the mentioned violation.

Protection of Minors (Digital ECA - Law No. 15.211/2025). The platform adopts the guidelines of the Statute of the Child and Adolescent for the digital environment, as well as other applicable rules and good practices, prioritizing full protection and the principle of best interest.

Age Verification: PopMe does not accept mere self-declaration. Users’ ages will be confirmed through reliable verification mechanisms at the time of registration.
Digital Well-Being: in compliance with the legislation, PopMe does not use addictive design features, such as infinite scroll or automatic video playback (autoplay), to harmfully retain the attention of young people.

Content, Submitted Data, and Intellectual Property

Intellectual Property. By accessing the Platform, you declare that you will respect all of PopMe’s intellectual property rights, including, but not limited to, computer programs, copyrights, and industrial property rights over trademarks, patents, domain names, corporate name, and industrial designs, possibly filed or registered in the name of PopMe, as well as all rights concerning third parties that may be, or have been, in any way, available on the Platform, with any infringement thereof potentially giving rise to the payment of indemnification for judicially determined losses and damages.

Content. You hold all intellectual property rights over the original content you publish on PopMe.

By posting content, you grant PopMe a non-exclusive, royalty-free, and limited license to use, reproduce, and display the content exclusively for the operation of the platform and validation of the proof of trust.

You are not authorized to modify or commercialize, in whole or in part, any Content made available by the platform, whether for a fee or free of charge. Any unauthorized use may result in civil and criminal penalties, both by PopMe and by third-party holders of the rights over the Content.

Furthermore, by using the platform, you declare and warrant that you will not submit content that infringes third-party rights, including, but not limited to, images, voices, trademarks, or any material protected by copyright without proper authorization. The violation of these provisions may result in the suspension or termination of your access to the Platform, without prejudice to other applicable legal measures.

Absence of guarantees regarding Your Data and Content. PopMe does not guarantee the quality, consistency, integrity, form, timeliness, or source of the Content or Your Data, as we do not control, verify, or make judgments about this Content and Your Data. We are not responsible, therefore, for any untruthfulness, obsolescence, or error of this Content or Your Data, nor are we responsible for any damages arising from this Content, on any grounds.

Algorithmic intelligence. The Platform, in an impersonal and automatic manner, may apply statistical models and algorithmic intelligence to index, filter, and organize the Content or Your Data, generated or shared through the Platform.

You declare yourself aware that PopMe, unless at its sole discretion, will not disclose or provide you or any third party with any systemic or algorithmic information related to the Platform.

Disclaimer and Limitations of Liability

Availability of the Platform. PopMe makes its efforts to maintain the continuous and permanent availability of the Platform. However, temporary unavailability may occasionally occur due to necessary maintenance or even caused by force majeure, such as natural disasters, failures in communication systems and Internet access, invasive cyberattacks, or any third-party events that are outside the scope of PopMe’s surveillance and responsibility.

If this occurs, PopMe will do what is within its reach to restore access to the Platform as soon as possible, within the technical limitations of its services and third-party services on which it depends to stay online. For this reason, You are aware that you may not claim indemnification or reparation for damages in the event that the Platform remains offline, regardless of the motivation.

Without prejudice to other conditions of these Terms, PopMe is not responsible:

For any problems, bugs, glitches, or improper functioning that occur on your devices and equipment;
For any direct or indirect damage caused by third-party events, such as, but not limited to, hacker attacks, failures in the system, server, or internet connection, including by actions of software that may, in some way, damage physical or logical assets as a result of accessing, using, or browsing the Platform;
For the improper use of images, voices, texts, or any other content protected by copyright, image rights, voice rights, or third-party intellectual property, submitted, uploaded, or generated by users on the Platform. It is the user’s sole responsibility to ensure that they have all the authorizations, licenses, or permissions necessary to use such content, including the express consent of the holders, where applicable. PopMe is not responsible for violations resulting from the inappropriate or unauthorized use of these materials, with the user being fully liable for any claims, losses, or damages caused to third parties;
For browsing any external links made available on the Platform, it being your duty to read the Terms of Use and Privacy Policy of the accessed service and to act as determined; and
For verifying, controlling, approving, or guaranteeing the adequacy or accuracy of the information or data made available in such links to third-party services, and is therefore not responsible for losses, damages, or harm caused by visiting such Platforms, with the interested party being responsible for verifying the reliability of the information and data displayed there before making any decision or taking any action.

Privacy and Protection of Personal Data

Personal Data. During the use of the Platform, in order to access certain features, information may be required with the aim of maintaining your security and confidentiality. PopMe has its own document, called the Privacy Notice, which regulates the processing of Personal Data processed on the Platform, being an integral and inseparable part of these Terms and which can be accessed through this link, also being available at any time on the Platform.

PopMe will monitor, by appropriate means, its own compliance with the respective Personal Data protection obligations.

Security Recommendations

Access to the Platform. Whenever you access the Platform, verify that you are in fact in the environment provided by PopMe; the actions of hackers may, in an attempt to steal your data, replicate a Platform or areas thereof.

Penalties

Penalties. Non-compliance with these Terms may result in: (i) temporary suspension of the Platform; (ii) removal of content; (iii) definitive cancellation and banning of the user (in the case of technical fraud or serious violations); and/or (iv) accountability in the civil and criminal spheres.

You acknowledge from now on and undertake, during the use of the Platform, not to perform any actions that offend morality, ethics, and good faith, undertaking under no circumstances to disclose, instigate, or assist in the practice of illegal or fraudulent acts, and must combat them whenever you become aware of them, under penalty of the provisions of this clause.

Zero Tolerance for Questionable Content and Abusive Users. PopMe adopts a strict zero-tolerance policy regarding questionable, abusive, defamatory, discriminatory, violent, obscene content, or content that in any way harasses other users or violates current legislation. The user undertakes not to create, publish, or share any material of this nature. The violation of this rule will result in the immediate removal of the infringing content and the permanent banning of the responsible user, without prior notice.

Retention and Deletion

Inactivity. Accounts inactive for a period longer than 24 (twenty-four) months may be deactivated in accordance with PopMe’s governance Policy.

Before the deactivation of the account, the User will be previously notified by PopMe about the identified absence of activity, being granted a reasonable period to respond or reactivate usage, as applicable.

Deletion. You may request the deletion of your data via the PopMe application or by e-mailing dpo@popme.io. Anonymized data may be kept for statistical purposes and infrastructure security.

General Provisions

Service Channels. You may use the Service Channels provided on the Platform whenever you witness or verify inappropriate content on the Platform, whether it is notably illegal or contrary to the usage rules stipulated in these Terms.

Update of the Terms. These Terms are subject to constant improvement and enhancement. Thus, PopMe reserves the right to modify them at any time, according to its purpose or convenience, as well as for the adaptation and legal compliance of a provision of law or a rule with equivalent legal force, including from regulatory bodies; that is, you must check them whenever you access the Platform.

Novation and waiver. Tolerance of the eventual breach of any conditions of these Terms will not constitute a waiver or novation, nor will it prevent PopMe from demanding these conditions at any time.

Nullity. If any provision of these Terms is deemed inapplicable or void, the remainder will continue to be in full force.

Communication. You acknowledge that all communication carried out by e-mail, SMS, WhatsApp, or telephone is valid, effective, and sufficient for the disclosure of any matter relating to the Platform.

Referrals. Access to the Platform may direct you to other platforms linked to PopMe which, due to their particularities, will have their own Terms of Use and Privacy Policy, and it is your responsibility to read these documents.

Date and time. The Platform is based on the official date and times of Ohio (UTC/GMT -05:00).

Applicable law and jurisdiction. These Terms will be interpreted according to Brazilian legislation, in the Portuguese language, and the jurisdiction of the City of Salvador, State of Bahia, is elected to settle any controversy, unless the applicable legislation specifically provides for another personal, territorial, or functional competence.
